Terms of Service

These Terms of Service ("Terms") govern your use of FieldTender Presence services provided by FieldTender ("we," "us," or "our"). By purchasing our service — including by completing payment through our Stripe payment link — you agree to these Terms.

1. The service

FieldTender Presence is a done-for-you web presence service for home service contractors. The service includes:

• A custom website built from our templates and tailored to your trade and location
• Google Business Profile creation and/or optimization
• Local SEO setup (on-page optimization, citation consistency)
• Ongoing hosting on Cloudflare Pages
• Active SEO management (GBP posts, review responses, rank tracking, citation monitoring, monthly reporting) — optional, available as an add-on described in Section 2

We aim to have your website live within 48 hours of receiving your completed intake form and payment. The 48-hour clock starts when we have everything we need from you — not when payment is received. If we do not deliver your live website and Google Business Profile within 48 hours of receiving your completed intake form, your build fee is automatically reduced by $200.

2. Fees and billing

• Build fee: $1,197, due at time of purchase. One-time, non-refundable once work has begun — except as reduced by the 48-hour delivery guarantee described in Section 1.
• Hosting fee: $19/month, billed monthly starting on the date your site goes live. Covers hosting, domain renewal (where applicable), and SSL. No minimum term.
• Active management fee (optional): $197/month, billed monthly if and when you add it. This is not sold or billed at signup — it's offered starting after your first full month of hosting, once you've seen your own results. No minimum term; you may add or cancel it independently of hosting at any time.
• Domain registration: ~$10–15/year, billed directly to you at cost through Cloudflare. Your domain is registered in your name on your own account — we never hold it.

Payments are processed via Stripe. By providing payment information you authorize us to charge the amounts above on the schedule described. If a payment fails, we'll notify you and attempt to retry. Service may be suspended after 7 days of non-payment.

3. Term and cancellation

There is no minimum term. Hosting bills at $19/month and may be canceled at any time by emailing hello@fieldtender.com — you will be billed through the end of the billing period in which you cancel. Active management, if added, can be canceled separately and at any time on the same basis.

We may cancel your account for non-payment or material breach of these Terms, with written notice.

4. What you own

You own your domain, your Google Business Profile, and all content we create specifically for your business (copy, photos you provide, and your business information). Upon cancellation, we will export your site files and provide them to you within 5 business days so you can host them elsewhere.

We retain ownership of our template code, design system, and build tooling. Your site is built on top of these — you own the output, not the underlying framework.

5. What we need from you

To deliver the service, you agree to:

• Provide accurate business information on the intake form
• Respond to our questions in a reasonable time (delays on your end may delay the 48-hour SLA)
• Create a Cloudflare account (free) for domain registration — we'll walk you through it
• Grant us manager access to your Google Business Profile for setup and ongoing maintenance

6. Acceptable use

You may not use our service to promote illegal activity, deceptive business practices, or any content that violates applicable law. We reserve the right to refuse or terminate service for any client whose business we determine, in our sole judgment, violates this policy.

7. Limitation of liability

We are not responsible for changes Google makes to its Business Profile platform, algorithm updates that affect search rankings, or third-party service outages (Cloudflare, Google, Stripe). SEO results are not guaranteed — we follow best practices, but search rankings depend on factors outside our control.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to these Terms or our service shall not exceed the total fees you paid us in the 12 months preceding the claim.

8. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ramsey County, Minnesota.

9. Changes to these Terms

We may update these Terms occasionally. We'll notify active clients by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

Changelog

• August 17, 2026 — Restructured pricing: replaced the $297 setup fee / $197 flat monthly fee with a $1,197 one-time build fee, $19/month hosting (no minimum term), and an optional $197/month active management add-on offered starting after your first month. Removed the 3-month minimum term and 30-day cancellation notice in favor of cancel-anytime. Added the 48-hour delivery guarantee ($200 credit if we miss it).
• July 20, 2026 — Effective date set; added Stripe payment link acceptance language.
